[파이낸셜뉴스] 최근, 심심치 않게 무역사기에 관한 문의가 들어오고 있다. 대부분 비슷한 패턴을 보이며, 피해사례가 늘어가고 있다. 피해 금액도 적지 않다. 거래가 이루어지기 전에 피해 예방차원에서 확인절차를 정확히 밟았으면 하는 안타까움이 크다. 행여 자칫 거래가 불발되지는 않을까하는 마음, '확인된' 몇 가지 서류들을 믿고 거래를 진행할 수 밖에 없었던 피해업체들의 마음도 충분히 이해가 된다. 다행히, 그 수법의 패턴이 크게 다르지 않기에, 몇가지 사례를 공유함으로써 앞으로의 피해를 조금이나마 줄일 수 있기를 희망한다. 몇 가지 대표적인 무역거래 사기 유형을 소개한다. #1. 국내 업체 A는 미국에 있는 B업체로부터 게임기 부품 수입에 대해 공급 조건을 문의 받았다. A업체는 제일 먼저 B 업체의 사업자 등록증을 확인했고, 추가로 B 업체의 이름을 구글에 검색해봤다. 꽤나 그럴싸한 홈페이지와 인스타그램 계정, 게다가 고객 후기도 여러개 올라와 있었기에 거래를 하기로 마음먹었다. 거래 요구 조건은 단순했다. 먼저 선수금 50%를 송금하면 나머지는 B 업체가 선적 후 송금하면 된다고 했다. 하지만 선수금 50%가 송금된 후, B업체는 추가 금액을 요구 하기 시작했다. 그제서야 A 업체는 현지에 있는 변호사를 통해 B 업체의 실체에 대해 알아보기 시작했다. 확인 결과, B 업체가 처음 보내준 사업자등록증은 위조된 것이었으며, 홈페이지도 블랙리스트에 등록돼 있던 주소였다. #2. D업체는 미국에 한국 화장품이 붐이 일고 있다며, 국내 화장품 업체 C에게 미국 시장 진출을 제안했다. 소규모 업체였던 C는 자신들의 상품을 높게 평가해주며, 실제로 여러차례의 화상통화와 미팅들을 통해 적극적으로 다가왔던 D업체를 신뢰할 수 밖에 없었다. 이후, 대량오더가 포함된 계약서를 보내주고, 제품 특성상 품질 테스트 비용 및 인증비용이 필요하다며 1차 금액을 요구했다. 계약이 이루어지는 과정의 일부분이라 여기고, 바로 1차 금액을 송금하였다. 1차 송금 이후에도, 계속되었던 화상미팅들에 안심하고 있다가 2차 금액 요구시 송금 정보가 바뀐 것을 알아채고 이상함을 느낀 C 업체가 사실 확인을 종용하자, 연락이 끊어졌다. 이러한 무역사기를 예방하려면 어떻게 해야할까. 다음의 세 가지를 우선 확인했으면 한다. 첫째, 기업 등록 확인이다. 단순히 업체 홈페이지나 소셜네트워크서비스(SNS)계정들을 확인하는 것에서 그칠 것이 아니라, 이 업체가 제대로 등록된 업체인지 직접 확인해봐야 한다. 미국이라 한다면, 각 주의 Department of State 혹은 Secretary of State으로 검색해 들어가보면 등록된 기업을 이름, 주소, 혹은 대표자 이름으로 검색이 가능하다. 언제 등록이 되어있는지, 또 등록된 기록에 나와있는 주소를 찾아보고 홈페이지나 구글에 나오는 정보와 일체 하는지 한번 더 확인하는 것이 좋겠다. 유사이름으로 접근 하는 경우도 많기 때문에, '비슷한 정보'로는 충분치 않다. 둘째, 현지 전문인 또는 직접 확인. 일어나지 않은 피해를 막고자 비용을 쓰는것에 망설임이 있겠지만, 대부분의 경우 거래금액의 액수가 적지 않기에, 이럴 때는 현지에서 활동하고 있는 전문가를 통해 확인하는 것을 추천한다. 꼭 변호사가 아니더라도, 현지에서 직접 방문 확인이 가능한 사람을 통해 확인하는 것도 방법이다 셋째, 사기업체 피해 조회 검색 사이트 등을 통해 확인. 국제 온라인 사기피해 신고를 할 수 있을 뿐 아니라, 사기업체 나 사례를 검색 해 볼 수 있는 사이트가 있다. 처음 거래하는 업체라면, 이러한 소스를 통해서 한 번 더 확인하고, 다른 피해사례들과 비교하다보면 의심스러운 정황을 포착할 수 있어서 피해 예방이 도움이 될 수 있겠다. 무역사기의 경우, 피해 보상이 어렵다. 그 이유는 크게 두가지로 나뉜다. '작정'하고 사기를 친 업체 혹은 개인을 찾기가 어렵다. 나중에 찾고 나면, 연락처는 물론, 은행 계좌도 실존하지않는 이름으로 돼있다. 게다가 대부분의 은행들은 보안상의 이유로 더이상의 협조를 하지 않다보니 이미 한번 넘어간 금액을 돌려받기란 불가능에 가깝다. 또한 어떤방법으로 사기를 친 업체나 개인을 찾았다 하더라도 소송절차가 간단하지 않고, 소송비용이 발생한다. 대부분의 경우, 계약서에 명시돼 있지 않는 한, 피해를 입었다 하더라도 상대측으로부터 소송비용까지 받아낼 수는 없다. 그렇기에, 오더가 포함된 영수증만보다는, 간략하더라도 중요 내용이 포함된 계약서 작성이 아주 중요하다. 계약서 작성을 요구하면, 확률적으로 사기업체들이 주저하거나 중간에 포기하고 물러나는 경우들도 있으니, 정식계약서를 요구하고 진행하는 것이 좋겠다. 강지니 미국 변호사·미주한인소상공인총연합회 부회장 ehcho@fnnews.com 조은효 기자
2024-06-08 14:35:23[파이낸셜뉴스] [수담활론(手談闊論)]은 각 분야의 전문가들의 글(수담)을 통해 우리사회 곳곳의 이슈들을 파악하고 보다 쉽게 이해하기 위해 마련됐습니다. <편집자 주> 미국에 15살에 와서 정착한 이후 지난 25년간 미국에서의 우리나라의 위상이 나날이 높아지는 것에 큰 자부심을 느낀다. 한국이라는 나라에 대해 모르거나 단순히 전쟁을 겪었던 작은 나라정도로 치부됐던 예전과는 다르게, 요즘은 어딜 가나 K-팝(pop), K-푸드(food), K-드라마(drama)가 핫 트렌드로 떠오르며 그야말로 'KKK시대'라고도 불린다. 이에 따라 한국문화에 대한 관심을 물론 한국물건에 대한 수요가 높아지며 한때 한국의 수출기업 수가 10만개를 돌파하기도 했다. 그러다 코로나19로 인해 국가 간 교역이 줄어들고 글로벌 경기침체가 이어지며 한국의 크고 작은 수출업체들이 입은 타격은 몸소 느낄 정도이다. 대부분의 대기업들은 어려운 상황속에서도 버텨낼 수 있는 '힘'이 있지만 중소규모의 기업들은 수출경로는 물론이거와 현지에서의 자금지급이 제대로 이뤄지지 않을 경우 입게 되는 타격이 작지 않다. 중소기업의 성장을 누구보다 지지하고 바라는 입장에서 미국과의 수출업을 하는 중소기업을 위한 '팁'을 몇가지 공유하고자 한다. 법적 등록이 되어 있는 회사인지 확인하는게 중요 때때로 한국에서 도움을 요청하는 전화를 받을때가 있다. 그 중에서도 안타까운 경우가 물건을 이미 보내고 돈을 못받고 있는 와중에 그제서야 상대회사에 대해 알아보니 제대로 등록도 되어있지 않고 실체도 불명확한 경우이다. 어찌보면 모든 민사소송의 시작은 가해자가 피해보상을 할 능력이 있는지에 대한 판단이다. 상대회사의 실체가 불명확하거나 이미 회사 재산이 없어진 경우는 책임을 물기 사실상 어렵기 때문이다. 어느 회사와 새로운 일을 시작할 때에는 가장 먼저 상대회사가 제공한 정보가 맞는지를 확인해야 한다. 예를 들어 플로리다 주에 등록된 회사라고 말한다면 플로리다 주정부의 기업부 홈페이지(Florida Department of State-Division of Corporation)에 들어가서 회사이름만 검색해봐도 간단하게 실제로 등록된 회사인지 알 수 있다. 회사대표의 정보는 물론 해마다 제대로 갱신해왔는지 실제 사업체주소는 어디인지 등을 확인할 수 있다. 주마다 명칭 차이는 있을 수 있지만, 보통 'Secretary of State' 혹은 'Department of State'을 검색해 들어가면 어렵지 않게 기업정보를 확인할 수 있다. 지난해 한 기업체 사장의 경우 이같은 확인작업은 하지 않고 이메일로 진행한 '확인 메일'만 믿고 3000만원 정도의 물건을 보냈다가 상대회사가 연락을 끊어 어려움을 겪기도 했다. 어렵지 않은 절차이니 수출계약건 진행 전에 꼭 확인해보기를 추천드린다. 사기방지법(Statute of Frauds)으로 법적 효력 증명 한국은 중앙집중적인 법제도를 갖추고 국가정부가 전체국가에 대한 권한을 가지고 있지만 미국은 연방법 제도로 연방정부와 개별 주 간에 권력이 분산된 이중체계의 시스템이다. 연방법원은 연방법과 연방사법을 규율하며 주법원은 주법과 주사법을 규율한다. 한국기업과 미국기업간 분쟁의 관할권은 해당사항의 구체적인 사정에 따라 다를 수 있겠지만 대부분은 계약문제이기 때문에 해당 회사가 위치한 주나 분쟁이 발생한 주의 주법원이 주권을 갖게 된다. 따라서 수출계약문제로 법적분쟁이 발생했을때 상대 회사가 법적 등록되어있는 주, 혹은 그렇지 않더라도 상대 회사가 물건을 수령한 곳의 주의 법이 어떻게 되어있는지에 따라 법적 절차나 피해보상의 경로에 차이가 있을 수 있다. 하지만 사기방지법은 미국 연방법률 체계에 존재하는 법적원칙으로 주마다 약간의 차이가 있지만 일반적으로 특정 유형의 계약이 법적으로 시행 가능하려면 서면으로 작성되어야 한다는 것을 요구하고 있다. 구두합의로부터 발생하는 사기나 거짓된 주장을 방지하기 위함이다. 예를 들어 △부동산 매매 계약 △1년이내로 이행할 수 없는 계약(계약조건이 체결일로부터 1년이내에 이행될 수 없는 경우) △500달러 이상인 상품 매매 계약 △결혼을 대가로 한 약속 (혹은 혼전계약) △토지에 대한 특정 권리 이전 계약은 기본적으로 서면으로 작성돼야 법적효력이 발생한다. 이 가운데 핵심은 500달러 이상의 상품 매매 계약에 관한 항목이다. 서면으로 작성돼야 하기 때문에 가장 이상적인 것은 현지 법조인의 도움을 받아 계약서 작성 및 검토를 해야 하지만 현실적으로 중소규모 업체들에게는 그마저도 부담이 될때가 있다. 그렇기에 계약서에 모든 항목이 들어있지는 않다고 하더라도 양측 회사의 이름, 거래품목 및 금액 등 주요내용을 작성해 각 회사 대표가 서명한 문서가 있다면 괜찮다. 물론 서면계약서가 있으면 가장 좋겠지만 그렇지 않다 하더라도 영수증(Invoice)이 있다면 그 영수증 자체가 계약서 역할을 할 수 있으니 영수증에 양측 회사의 이름과 연락처, 거래품목 및 금액등을 자세히 기재하는것이 중요하다. 변호사 비용 부담 조항 잊지 말아야 막상 계약위반이 일어난 후 상대회사에게 민사소송을 제기하려 하더라도 상대적으로 적은 피해금액에 대비해 비싼 소송비용을 감당하기에 큰 부담이 된다. 일반적으로 생각할때 소송에서 이기고 나면 당연히 가해자 쪽에서 변호사 비용 및 소송비용을 감당할 것으로 생각하지만 변호사 비용 조항이 계약서에 포함돼 있지 않은 경우 기본적으로 소송비용은 각자 부담하게 되어있다. 이 때문에 서면 계약서, 영수증 등 형식에 상관없이 나중에 있을지 모를 법적분쟁을 대비해 꼭 변호사비용 조항을 포함하는 게 좋다. 일부 기업들 가운데에는 상대가 소송비용 부담으로 스스로 포기하기를 기다리면서 '버티기'를 시전하며 대응 자체를 미루는 경우도 있다. 때로는 제대로 작성된 문서만으로도 원만한 합의를 이끌어 낼 수도 있다. 다만 모든 법률 문제는 각 상황마다 다르고 사실에 따라 관할권과 결과가 달라질 수 있다. 위에 제공된 정보는 일반적인 사례일뿐 특정 상황에 맞는 조언과 상담은 관할권을 가진 주의 면허를 가진 변호사나 법률 전문가와 상담하기를 추천드린다. 아무쪼록 코로나 이전시대와 같이 우리나라 기업의 수출액이 꾸준한 성장세로 이어지기를 기대해본다. /강지니 미국 변호사. 미주한인소상공인총연합회 부회장 ※이 글은 필자의 주관적인 견해이며, 본지의 편집방향과 다를 수 있습니다. kim091@fnnews.com 김영권 기자

2022-03-22 16:18:46코로나바이러스(코로나19) 확산으로 인하여 물류비 상승 등 대내외 환경이 최악인 상황 속에서 원자재 가격의 가파른 상승으로 중소기업의 생존이 위협받고 있다. 한국은행이 발표한 5월 기준 수입물가지수는 112.41로 전월보다 2.6% 오른 것으로 밝혀졌다. 이런 가운데 중소기업이 최근 해외 기업과 국제 거래를 하는 과정에서 분쟁이 생겨 물품대금 소송으로까지 이어지는 사례가 증가하고 있다. 국내 중소기업 A사는 해외의 B사와 제작물 공급계약을 체결하였는데 그 주요 내용은 A사는 부품을 구입하여 제공하고 B사는 부품을 조립하여 최종 완성품인 제품을 C사에게 납품하는 것 이였다. 그런데 C사가 최종 완성품에 하자를 이유로 대금 지급을 거절하여 소송으로 이어지게 되었다. 국내 중소기업 D사는 USB케이블을 납품하는 계약을 E사와 체결하였고, 이 사건 계약에는 D사가 납품한 물품의 품질에 하자가 있으면 D사가 이에 대한 모든 책임을 진다는 규정과, D사가 납품한 물건이 불량으로서 하자가 있을 때 D사가 이에 대한 책임을 모두 진다고 규정하고 있었다. 그런데 USB 케이블에 불량이 발생하여 E사는 물품을 전량 회수하게 되었고, 이로 인한 피해로 E사는 D사에게 물품대금을 지급하지 않자 소송으로 이어지게 되었다. 국내 중소기업 F사는 해외의 G사와 납품 계약을 체결하고, G사에 납품할 제품을 생산, 공급할 목적으로 E사와 계약을 체결하였으나, E사의 납기일 미준수로 G사로부터 주문 일부를 취소 당하는 손해를 입었고 계속적 거래 관계도 종결되는 피해를 입었다. 법률사무소 플랜의 김민진 변호사는 “위의 사례는 모두 최근 직접 진행한 중소기업 물품대금 사건의 대표적인 사례”라며 “계약서에서 먼저 중요하게 살펴봐야 할 사항은 분쟁이 생기는 경우 어느 나라 법에 따라 어느 나라 법원에서 재판을 할 것인지, 아니면 중재를 통해 해결할 것인지를 결정해야 하는 것이다. 만일 이러한 결정이 일방에게 유리한 지역이나 방식으로 정해지는 경우 그 반대 입장에서는 법적 해결에 상당한 부담을 느끼게 되고 결국 아주 중대한 문제나 큰 금액에 대한 손해배상이 아닌 한 손해를 감수할 수밖에 없는 상황에 놓일 수밖에 없다. 따라서 계약서를 작성할 때 만일의 분쟁에 대비하여 준거법 및 관할 등에도 신경을 기울여야 한다”고 조언했다. 이어 김민진 변호사는 “물론 국내 중소기업은 계약 관계에서 을의 입장에 서있으므로 행여 까다롭게 굴면 계약이 안될 것이라는 우려에 ‘울며 겨자 먹기’식으로 그냥 사인하는 경우가 있다. 그러나 자신의 정당한 권리를 보호받고 요구하는 조항을 삽입해야 나중에 큰 후회를 막을 수 있다.”고 신신당부했다. 물품대금 소송이 제품 하자에서 비롯된 경우의 법적 공방 물품대금 소송에서, 제품 하자로 인한 원인으로 대금지급을 거절하거나 손해가 발생한 경우에는 전문 기관의 시험 성적서나 보고서를 제출하여 하자 발생의 책임을 물을 수 있다. 법률사무소 플랜의 김민진 변호사는”관련 시험성적서나 보고서에 오류가 없는지 면밀하게 검토하고, 필요한 경우 법원 감정 절차를 통하여 정확한 하자의 원인을 명확하게 확인할 필요성도 있다”며 “물품대금 소송 진행 시 사건의 경위와 체결한 계약의 성격을 명확히 확인하고, 제품과 기술에 대한 이해와 분석을 바탕으로 소송을 진행 한다면 보다 효과적으로 분쟁에 대응 할 수 있다”고 전했다. 계약서뿐 아니라 외국회사와 거래할 때 최우선적으로 파악해야 하는 사항은 수입업체의 법적 지위와 신용도를 확인해두는 것이다. 일단 수출업체가 큰 비용을 들이지 않고 수입업체의 신용도를 사전에 확인하는 방법은 해외 수입업체의 신용조회다. 미국의 경우 대부분의 주 정부 웹사이트(Secretary of State)를 방문하면, 거래하고자 하는 기업의 현 상태를 볼 수 있는 정보(Entity Information)가 공개돼 있다. 개인사업체(individual or sole proprietorship)는 동업자 없이 소유주 한 개인에 의해 사업이 운영되고, 소유주는 기업의 경영자이며 운영자가 된다. 개인사업자는 기업을 설립할 때 필요한 법적인 절차가 다른 형태보다 간단하다. 소유주가 비즈니스 관리나 회사 이익금 사용 결정 등을 통제할 수 있는 권한이 있으므로 보통 비즈니스를 시작하는 단계에서 많이 선호하는 회사 형태다. 반면, 개인부채와 법적 책임도 소유주에게 무한책임이 따르는 부담감도 있다. 법률사무소 플랜의 김민진 변호사는 “이 사이트에선 부동산 자산정보, 금융정보 및 해당업체의 파산 또는 소송정보까지 확인할 수 있다. 조사 결과 만일 과거에 파산이력, 현재 체납세금 또는 다른 업체와의 소송이 진행중인 걸 확인했다면 즉시 추가적인 물품선적을 그만두고 법적 대응책을 마련해야 할 것이다.”라고 전했다. 다음으로 수출업체가 수입업체와 거래조건에 대해 협상을 하거나 계약을 하기 이전에, 수입업체에 대한 신용도(Credit Rating)를 반드시 조회해야 한다. 미국의 경우 기업의 신용등급을 조사해 유료서비스로 제공하는 기관을 활용할 수 있다. 그러나 비용이 비싸고, 회사이름으로 대출 또는 자산의 구입이력이 없는 소규모의 기업에 대한 정보는 없을 수 있다. 이럴 때는 우리나라의 한국무역보험공사(K-Sure)의 국외기업 신용조사 프로그램을 활용할 수 있다. 이 서비스는 해외지사 및 전 세계 신용조사기관을 통해 국외기업 정보를 조사한 후 신청인에게 신용조사 보고서를 제공하는 서비스다. 향후 국외기업의 신용위험 및 비상위험을 담보하는 무역보험에 가입하기 위해서는 사전에 국외기업 신용조사를 의뢰하는 것이 바람직하다. 국제 무역거래에 있어 계약서는 수입자의 신용 리스크를 최소화하고, 분쟁을 해결할 수 있는 최선의 장치다. 거래당사자와의 거래관계 및 의무와 책임에 대한 부분을 입증하는 결정적인 문서로서 역할을 하기 때문이다. 그러므로 비용 부담을 감수하고라도 전문가를 통해 거래물품의 정보, 상환조건, 선적지연일 등 세부사항을 철저하게반영하면 사후 분쟁 시 큰 도움이 될 수 있다. 법률사무소 플랜의 김민진 변호사는 “덧붙여 수출자, 수입자의 법인명, 주소, 권한있는 자의 성명 및 서명을 정확히 확인하고 기재해 계약관계를 확실하게 해 둬야 대금 미회수 등 추후 발생할 수 있는 분쟁에 대비할 수 있다. 그리고 처음 거래하는 업체이거나 계약대금이 고액인 경우, 대금결제조건을 신용장 방식으로 하는게 안전하다.”고 조언했다. 해외의 기업과 물품 대금 분쟁을 겪거나 소송로 이어지게 된다면, 중소기업에게는 시간∙경제적 손실뿐 아니라 물리적•언어적 장벽으로 힘든 점이 많다. 따라서 계약할 때부터 분쟁이나 손해 발생 처리 방식을 철저하게 합의해 둬야 불이익을 줄일 수 있다.

Small business confidence is at an all-time high. The stock market has smashed one record after another, gaining $8 trillion in value. That is great news for Americans' 401k, retirement, pension, and college savings accounts. And just as I promised the American people from this podium 11 months ago, we enacted the biggest tax cuts and reforms in American history. Our massive tax cuts provide tremendous relief for the middle class and small businesses. To lower tax rates for hardworking Americans, we nearly doubled the standard deduction for everyone. Now, the first $24,000 earned by a married couple is completely tax-free. We also doubled the child tax credit. A typical family of four making $75,000 will see their tax bill reduced by $2,000 — slashing their tax bill in half. This April will be the last time you ever file under the old broken system — and millions of Americans will have more take-home pay starting next month. We eliminated an especially cruel tax that fell mostly on Americans making less than $50,000 a year — forcing them to pay tremendous penalties simply because they could not afford government-ordered health plans. We repealed the core of disastrous Obamacare — the individual mandate is now gone. We slashed the business tax rate from 35 percent all the way down to 21 percent, so American companies can compete and win against anyone in the world. These changes alone are estimated to increase average family income by more than $4,000. Small businesses have also received a massive tax cut, and can now deduct 20 percent of their business income. Here tonight are Steve Staub and Sandy Keplinger of Staub Manufacturing — a small business in Ohio. They have just finished the best year in their 20-year history. Because of tax reform, they are handing out raises, hiring an additional 14 people, and expanding into the building next door. One of Staub's employees, Corey Adams, is also with us tonight. Corey is an all-American worker. He supported himself through high school, lost his job during the 2008 recession, and was later hired by Staub, where he trained to become a welder. Like many hardworking Americans, Corey plans to invest his tax‑cut raise into his new home and his two daughters' education. Please join me in congratulating Corey. Since we passed tax cuts, roughly 3 million workers have already gotten tax cut bonuses — many of them thousands of dollars per worker. Apple has just announced it plans to invest a total of $350 billion in America, and hire another 20,000 workers. This is our new American moment. There has never been a better time to start living the American Dream. So to every citizen watching at home tonight — no matter where you have been, or where you come from, this is your time. If you work hard, if you believe in yourself, if you believe in America, then you can dream anything, you can be anything, and together, we can achieve anything. Tonight, I want to talk about what kind of future we are going to have, and what kind of Nation we are going to be. All of us, together, as one team, one people, and one American family. Young patriots like Preston teach all of us about our civic duty as Americans. Preston's reverence for those who have served our Nation reminds us why we salute our flag, why we put our hands on our hearts for the pledge of allegiance, and why we proudly stand for the national anthem. Americans love their country. And they deserve a Government that shows them the same love and loyalty in return. For the last year we have sought to restore the bonds of trust between our citizens and their Government. Working with the Senate, we are appointing judges who will interpret the Constitution as written, including a great new Supreme Court Justice, and more circuit court judges than any new administration in the history of our country. We are defending our Second Amendment, and have taken historic actions to protect religious liberty. And we are serving our brave veterans, including giving our veterans choice in their healthcare decisions. Last year, the Congress passed, and I signed, the landmark VA Accountability Act. Since its passage, my Administration has already removed more than 1,500 VA employees who failed to give our veterans the care they deserve — and we are hiring talented people who love our vets as much as we do. I will not stop until our veterans are properly taken care of, which has been my promise to them from the very beginning of this great journey. All Americans deserve accountability and respect — and that is what we are giving them. So tonight, I call on the Congress to empower every Cabinet Secretary with the authority to reward good workers — and to remove Federal employees who undermine the public trust or fail the American people. In our drive to make Washington accountable, we have eliminated more regulations in our first year than any administration in history. We have ended the war on American Energy — and we have ended the war on clean coal. We are now an exporter of energy to the world. In Detroit, I halted Government mandates that crippled America's autoworkers — so we can get the Motor City revving its engines once again. Many car companies are now building and expanding plants in the United States — something we have not seen for decades. Chrysler is moving a major plant from Mexico to Michigan; Toyota and Mazda are opening up a plant in Alabama. Soon, plants will be opening up all over the country. This is all news Americans are unaccustomed to hearing — for many years, companies and jobs were only leaving us. But now they are coming back. Exciting progress is happening every day. To speed access to breakthrough cures and affordable generic drugs, last year the FDA approved more new and generic drugs and medical devices than ever before in our history. We also believe that patients with terminal conditions should have access to experimental treatments that could potentially save their lives. People who are terminally ill should not have to go from country to country to seek a cure — I want to give them a chance right here at home. It is time for the Congress to give these wonderful Americans the "right to try." One of my greatest priorities is to reduce the price of prescription drugs. In many other countries, these drugs cost far less than what we pay in the United States. That is why I have directed my Administration to make fixing the injustice of high drug prices one of our top priorities. Prices will come down. America has also finally turned the page on decades of unfair trade deals that sacrificed our prosperity and shipped away our companies, our jobs, and our Nation's wealth. The era of economic surrender is over. From now on, we expect trading relationships to be fair and to be reciprocal. We will work to fix bad trade deals and negotiate new ones. And we will protect American workers and American intellectual property, through strong enforcement of our trade rules. Tonight, I am calling on the Congress to produce a bill that generates at least $1.5 trillion for the new infrastructure investment we need. Every Federal dollar should be leveraged by partnering with State and local governments and, where appropriate, tapping into private sector investment — to permanently fix the infrastructure deficit. Any bill must also streamline the permitting and approval process — getting it down to no more than two years, and perhaps even one. Together, we can reclaim our building heritage. We will build gleaming new roads, bridges, highways, railways, and waterways across our land. And we will do it with American heart, American hands, and American grit. We want every American to know the dignity of a hard day's work. We want every child to be safe in their home at night. And we want every citizen to be proud of this land that we love. We can lift our citizens from welfare to work, from dependence to independence, and from poverty to prosperity. As tax cuts create new jobs, let us invest in workforce development and job training. Let us open great vocational schools so our future workers can learn a craft and realize their full potential. And let us support working families by supporting paid family leave. As America regains its strength, this opportunity must be extended to all citizens. That is why this year we will embark on reforming our prisons to help former inmates who have served their time get a second chance. Struggling communities, especially immigrant communities, will also be helped by immigration policies that focus on the best interests of American workers and American families. For decades, open borders have allowed drugs and gangs to pour into our most vulnerable communities. They have allowed millions of low-wage workers to compete for jobs and wages against the poorest Americans. Most tragically, they have caused the loss of many innocent lives. Here tonight are two fathers and two mothers: Evelyn Rodriguez, Freddy Cuevas, Elizabeth Alvarado, and Robert Mickens. Their two teenage daughters — Kayla Cuevas and Nisa Mickens — were close friends on Long Island. But in September 2016, on the eve of Nisa's 16th Birthday, neither of them came home. These two precious girls were brutally murdered while walking together in their hometown. Six members of the savage gang MS-13 have been charged with Kayla and Nisa's murders. Many of these gang members took advantage of glaring loopholes in our laws to enter the country as unaccompanied alien minors — and wound up in Kayla and Nisa's high school. Evelyn, Elizabeth, Freddy, and Robert: Tonight, everyone in this chamber is praying for you. Everyone in America is grieving for you. And 320 million hearts are breaking for you. We cannot imagine the depth of your sorrow, but we can make sure that other families never have to endure this pain. Tonight, I am calling on the Congress to finally close the deadly loopholes that have allowed MS-13, and other criminals, to break into our country. We have proposed new legislation that will fix our immigration laws, and support our ICE and Border Patrol Agents, so that this cannot ever happen again. The United States is a compassionate nation. We are proud that we do more than any other country to help the needy, the struggling, and the underprivileged all over the world. But as President of the United States, my highest loyalty, my greatest compassion, and my constant concern is for America's children, America's struggling workers, and America's forgotten communities. I want our youth to grow up to achieve great things. I want our poor to have their chance to rise. So tonight, I am extending an open hand to work with members of both parties — Democrats and Republicans — to protect our citizens of every background, color, religion, and creed. My duty, and the sacred duty of every elected official in this chamber, is to defend Americans — to protect their safety, their families, their communities, and their right to the American Dream. Because Americans are dreamers too. Here tonight is one leader in the effort to defend our country: Homeland Security Investigations Special Agent Celestino Martinez — he goes by CJ. CJ served 15 years in the Air Force before becoming an ICE agent and spending the last 15 years fighting gang violence and getting dangerous criminals off our streets. At one point, MS-13 leaders ordered CJ's murder. But he did not cave to threats or fear. Last May, he commanded an operation to track down gang members on Long Island. His team has arrested nearly 400, including more than 220 from MS-13. CJ: Great work. Now let us get the Congress to send you some reinforcements. Over the next few weeks, the House and Senate will be voting on an immigration reform package. In recent months, my Administration has met extensively with both Democrats and Republicans to craft a bipartisan approach to immigration reform. Based on these discussions, we presented the Congress with a detailed proposal that should be supported by both parties as a fair compromise — one where nobody gets everything they want, but where our country gets the critical reforms it needs. Here are the four pillars of our plan: The first pillar of our framework generously offers a path to citizenship for 1.8 million illegal immigrants who were brought here by their parents at a young age — that covers almost three times more people than the previous administration. Under our plan, those who meet education and work requirements, and show good moral character, will be able to become full citizens of the United States. The second pillar fully secures the border. That means building a wall on the Southern border, and it means hiring more heroes like CJ to keep our communities safe. Crucially, our plan closes the terrible loopholes exploited by criminals and terrorists to enter our country — and it finally ends the dangerous practice of "catch and release." The third pillar ends the visa lottery — a program that randomly hands out green cards without any regard for skill, merit, or the safety of our people. It is time to begin moving towards a merit-based immigration system — one that admits people who are skilled, who want to work, who will contribute to our society, and who will love and respect our country. The fourth and final pillar protects the nuclear family by ending chain migration. Under the current broken system, a single immigrant can bring in virtually unlimited numbers of distant relatives. Under our plan, we focus on the immediate family by limiting sponsorships to spouses and minor children. This vital reform is necessary, not just for our economy, but for our security, and our future. In recent weeks, two terrorist attacks in New York were made possible by the visa lottery and chain migration. In the age of terrorism, these programs present risks we can no longer afford. It is time to reform these outdated immigration rules, and finally bring our immigration system into the 21st century. These four pillars represent a down-the-middle compromise, and one that will create a safe, modern, and lawful immigration system. For over 30 years, Washington has tried and failed to solve this problem. This Congress can be the one that finally makes it happen. Most importantly, these four pillars will produce legislation that fulfills my ironclad pledge to only sign a bill that puts America first. So let us come together, set politics aside, and finally get the job done. These reforms will also support our response to the terrible crisis of opioid and drug addiction. In 2016, we lost 64,000 Americans to drug overdoses: 174 deaths per day. Seven per hour. We must get much tougher on drug dealers and pushers if we are going to succeed in stopping this scourge. My Administration is committed to fighting the drug epidemic and helping get treatment for those in need. The struggle will be long and difficult — but, as Americans always do, we will prevail. As we have seen tonight, the most difficult challenges bring out the best in America. We see a vivid expression of this truth in the story of the Holets family of New Mexico. Ryan Holets is 27 years old, and an officer with the Albuquerque Police Department. He is here tonight with his wife Rebecca. Last year, Ryan was on duty when he saw a pregnant, homeless woman preparing to inject heroin. When Ryan told her she was going to harm her unborn child, she began to weep. She told him she did not know where to turn, but badly wanted a safe home for her baby. In that moment, Ryan said he felt God speak to him: "You will do it — because you can." He took out a picture of his wife and their four kids. Then, he went home to tell his wife Rebecca. In an instant, she agreed to adopt. The Holets named their new daughter Hope. Ryan and Rebecca: You embody the goodness of our Nation. Thank you, and congratulations. As we rebuild America's strength and confidence at home, we are also restoring our strength and standing abroad. Around the world, we face rogue regimes, terrorist groups, and rivals like China and Russia that challenge our interests, our economy, and our values. In confronting these dangers, we know that weakness is the surest path to conflict, and unmatched power is the surest means of our defense. For this reason, I am asking the Congress to end the dangerous defense sequester and fully fund our great military. As part of our defense, we must modernize and rebuild our nuclear arsenal, hopefully never having to use it, but making it so strong and powerful that it will deter any acts of aggression. Perhaps someday in the future there will be a magical moment when the countries of the world will get together to eliminate their nuclear weapons. Unfortunately, we are not there yet. Last year, I also pledged that we would work with our allies to extinguish ISIS from the face of the Earth. One year later, I am proud to report that the coalition to defeat ISIS has liberated almost 100 percent of the territory once held by these killers in Iraq and Syria. But there is much more work to be done. We will continue our fight until ISIS is defeated. Army Staff Sergeant Justin Peck is here tonight. Near Raqqa last November, Justin and his comrade, Chief Petty Officer Kenton Stacy, were on a mission to clear buildings that ISIS had rigged with explosives so that civilians could return to the city. Clearing the second floor of a vital hospital, Kenton Stacy was severely wounded by an explosion. Immediately, Justin bounded into the booby-trapped building and found Kenton in bad shape. He applied pressure to the wound and inserted a tube to reopen an airway. He then performed CPR for 20 straight minutes during the ground transport and maintained artificial respiration through 2 hours of emergency surgery. Kenton Stacy would have died if not for Justin's selfless love for a fellow warrior. Tonight, Kenton is recovering in Texas. Raqqa is liberated. And Justin is wearing his new Bronze Star, with a "V" for "Valor." Staff Sergeant Peck: All of America salutes you. Terrorists who do things like place bombs in civilian hospitals are evil. When possible, we annihilate them. When necessary, we must be able to detain and question them. But we must be clear: Terrorists are not merely criminals. They are unlawful enemy combatants. And when captured overseas, they should be treated like the terrorists they are. In the past, we have foolishly released hundreds of dangerous terrorists, only to meet them again on the battlefield — including the ISIS leader, al-Baghdadi. So today, I am keeping another promise. I just signed an order directing Secretary Mattis to reexamine our military detention policy and to keep open the detention facilities at Guantánamo Bay. I am also asking the Congress to ensure that, in the fight against ISIS and al-Qa'ida, we continue to have all necessary power to detain terrorists — wherever we chase them down. Our warriors in Afghanistan also have new rules of engagement. Along with their heroic Afghan partners, our military is no longer undermined by artificial timelines, and we no longer tell our enemies our plans. Last month, I also took an action endorsed unanimously by the Senate just months before: I recognized Jerusalem as the capital of Israel. Shortly afterwards, dozens of countries voted in the United Nations General Assembly against America's sovereign right to make this recognition. American taxpayers generously send those same countries billions of dollars in aid every year. That is why, tonight, I am asking the Congress to pass legislation to help ensure American foreign-assistance dollars always serve American interests, and only go to America's friends. As we strengthen friendships around the world, we are also restoring clarity about our adversaries. When the people of Iran rose up against the crimes of their corrupt dictatorship, I did not stay silent. America stands with the people of Iran in their courageous struggle for freedom. I am asking the Congress to address the fundamental flaws in the terrible Iran nuclear deal. My Administration has also imposed tough sanctions on the communist and socialist dictatorships in Cuba and Venezuela. But no regime has oppressed its own citizens more totally or brutally than the cruel dictatorship in North Korea. North Korea's reckless pursuit of nuclear missiles could very soon threaten our homeland. We are waging a campaign of maximum pressure to prevent that from happening. Past experience has taught us that complacency and concessions only invite aggression and provocation. I will not repeat the mistakes of past administrations that got us into this dangerous position. We need only look at the depraved character of the North Korean regime to understand the nature of the nuclear threat it could pose to America and our allies. Otto Warmbier was a hardworking student at the University of Virginia. On his way to study abroad in Asia, Otto joined a tour to North Korea. At its conclusion, this wonderful young man was arrested and charged with crimes against the state. After a shameful trial, the dictatorship sentenced Otto to 15 years of hard labor, before returning him to America last June — horribly injured and on the verge of death. He passed away just days after his return. Otto's Parents, Fred and Cindy Warmbier, are with us tonight — along with Otto's brother and sister, Austin and Greta. You are powerful witnesses to a menace that threatens our world, and your strength inspires us all. Tonight, we pledge to honor Otto's memory with American resolve. Finally, we are joined by one more witness to the ominous nature of this regime. His name is Mr. Ji Seong-ho. In 1996, Seong-ho was a starving boy in North Korea. One day, he tried to steal coal from a railroad car to barter for a few scraps of food. In the process, he passed out on the train tracks, exhausted from hunger. He woke up as a train ran over his limbs. He then endured multiple amputations without anything to dull the pain. His brother and sister gave what little food they had to help him recover and ate dirt themselves — permanently stunting their own growth. Later, he was tortured by North Korean authorities after returning from a brief visit to China. His tormentors wanted to know if he had met any Christians. He had — and he resolved to be free. Seong-ho traveled thousands of miles on crutches across China and Southeast Asia to freedom. Most of his family followed. His father was caught trying to escape, and was tortured to death. Today he lives in Seoul, where he rescues other defectors, and broadcasts into North Korea what the regime fears the most — the truth. Today he has a new leg, but Seong-ho, I understand you still keep those crutches as a reminder of how far you have come. Your great sacrifice is an inspiration to us all. Seong-ho's story is a testament to the yearning of every human soul to live in freedom. It was that same yearning for freedom that nearly 250 years ago gave birth to a special place called America. It was a small cluster of colonies caught between a great ocean and a vast wilderness. But it was home to an incredible people with a revolutionary idea: that they could rule themselves. That they could chart their own destiny. And that, together, they could light up the world. That is what our country has always been about. That is what Americans have always stood for, always strived for, and always done. Atop the dome of this Capitol stands the Statue of Freedom. She stands tall and dignified among the monuments to our ancestors who fought and lived and died to protect her. Monuments to Washington and Jefferson — to Lincoln and King. Memorials to the heroes of Yorktown and Saratoga — to young Americans who shed their blood on the shores of Normandy, and the fields beyond. And others, who went down in the waters of the Pacific and the skies over Asia. And freedom stands tall over one more monument: this one. This Capitol. This living monument to the American people. A people whose heroes live not only in the past, but all around us — defending hope, pride, and the American way. They work in every trade. They sacrifice to raise a family. They care for our children at home. They defend our flag abroad. They are strong moms and brave kids. They are firefighters, police officers, border agents, medics, and Marines. But above all else, they are Americans. And this Capitol, this city, and this Nation, belong to them. Our task is to respect them, to listen to them, to serve them, to protect them, and to always be worthy of them. Americans fill the world with art and music. They push the bounds of science and discovery. And they forever remind us of what we should never forget: The people dreamed this country. The people built this country. And it is the people who are making America great again. As long as we are proud of who we are, and what we are fighting for, there is nothing we cannot achieve. As long as we have confidence in our values, faith in our citizens, and trust in our God, we will not fail. Our families will thrive. Our people will prosper.
